These Terms of Use (“Terms”) govern your access to and use of the ClickSign 360 platform, website, mobile interfaces, APIs, and related services (collectively, the “Service”), operated by 360 Technologies USA, LLC, a Florida limited liability company (“Company”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree, you must not use the Service.
- Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.
- Description of the Service
ClickSign 360 provides tools for electronic signatures, identity and document verification, certified email notifications, workflow automation, form creation, document storage, and related digital transaction services.
The Service includes, but is not limited to:
- Standard electronic signatures
- Live e-signatures (real‑time video signing)
- Identity & document verification
- Form Builder (data collection via mobile‑friendly web forms)
- In‑person signing
- AI Smart Field Detection
- SMS & email OTP authentication
- Certified email notifications with traceability
- Workflow automation
- Secure document storage
The Service does not provide legal advice, legal review, or validation of the legality of any document or transaction.
- No Legal Review or Validation
You acknowledge and agree that:
- We do not review, monitor, or validate the content of any document you upload, send, sign, or store.
- We do not determine whether a document or signature is legally valid, enforceable, or appropriate for your intended use.
- You are solely responsible for ensuring that your documents, workflows, and transactions comply with applicable laws.
- User Responsibilities
You agree to:
- Provide accurate information
- Maintain the confidentiality of your account
- Use the Service only for lawful purposes
- Ensure that documents you upload do not violate any law or third‑party rights
- Obtain all necessary consents from signers and recipients
You must not:
- Upload illegal, fraudulent, harmful, or infringing content
- Use the Service to harass, threaten, or deceive others
- Attempt to bypass security or access unauthorized areas
- Interfere with the Service or its infrastructure
- Identity & Document Verification
Identity verification is performed by an independent third‑party provider.
We store only the verification result, not the biometric data.
You acknowledge that:
- Verification results may not be accurate
- Verification does not guarantee identity, authenticity, or legality
- We are not responsible for errors, omissions, or failures in verification
- Live E‑Signatures (Real‑Time Video)
If you use Live e‑signatures:
- Video sessions are recorded
- Recordings are stored while your account remains active
- Recordings are not used for biometric analysis
- You are responsible for notifying participants that the session is recorded
- Certified Email Notifications
Certified email notifications may include:
- Sender and recipient information
- Message body
- Delivery events and traceability
- Timestamps
- A stored copy of the email
You acknowledge that email delivery depends on third‑party providers and may not be guaranteed.
- Third‑Party Providers
The Service relies on authorized and certified third‑party providers to support hosting, storage, communications, identity verification, analytics, and other operational functions. These providers may only use information as necessary to perform services on our behalf and are contractually required to maintain appropriate security and confidentiality standards.

- Data Storage and Retention
We store:
- Documents
- Identity verification results
- Video recordings
- Form Builder data
- Certified email copies
Only while your account remains active.
Upon account closure, data may be deleted permanently and cannot be recovered.
- Service Availability
The Service is provided “AS IS” and “AS AVAILABLE.”
We do not guarantee:
- Uninterrupted access
- Error‑free operation
- Delivery of emails or SMS
- Preservation of data
- Compatibility with all devices or browsers
- Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for:
- User errors
- Illegal or fraudulent documents
- Content uploaded or sent by users
- Loss of data due to external causes
- Failures of third‑party providers
- Damages arising from use or inability to use the Service
- Our total liability is limited to the amount you paid in the 12 months preceding the claim.
- Indemnification
You agree to indemnify and hold harmless the Company from any claims arising from:
- Your use of the Service
- Your documents or content
- Your violation of these Terms
- Your violation of any law or third‑party rights
- Dispute Resolution
- a) Consumers / Individual Users — Mandatory Arbitration
All disputes will be resolved by binding arbitration, not in court.
You waive:
- Jury trial
- Class actions
- Representative actions
- b) Business / Enterprise Clients — Florida Courts
For commercial clients, disputes will be resolved exclusively in the state or federal courts of Florida.
- Termination
We may suspend or terminate your account at any time for:
- Violations of these Terms
- Illegal or harmful activity
- Security concerns
- Non‑payment
You may terminate your account at any time.
- Changes to the Terms
We may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.
